The walkthrough

  1. 01Order your criminal history from the Colorado Bureau of Investigation, $6 online at cbirecordscheck.com. JDF 612 section 7 asks whether a verified copy dated within the last 20 days is attached, so order it close to the day you file.
  2. 02Check the caption on page 1 against your own records: court type, county, case number, and your name on the Defendant line. We typed in what you told us; the clerk will reject a wrong case number.
  3. 03Page 1, section 3. Tick the Colorado Bureau of Investigation box — it is required on every motion. Its address is already printed on the form. Tick the district or county court box and the prosecuting attorney box as well.
  4. 04Page 2, section 4. Tick the line that matches your case (petty, misdemeanor or felony) and write the offense name on it. Fill in the date you were sentenced and the date supervision ended.
  5. 05Page 3, section 5(b). If your Answer says you are eligible, tick “Is eligible for sealing under C.R.S. §§ 24-72-706 or 707”. Read section 5(a) above it once, end to end, before you tick anything.
  6. 06Page 4, sections 6 and 6(c). Whether you think the court should already have sealed this automatically, whether the case was appealed, and whether you still owe restitution. Answer these honestly; a false answer is what gets a motion denied.
  7. 07Page 5, section 9, the Certificate of Service. You must send a copy to the prosecuting attorney and say how you sent it. This is the step that sinks most self-filed motions.
  8. 08Page 5, section 10. Print your name, sign, and date it the day you file.
  9. 09File it with the clerk of the court in the county on the caption, attach your CBI record, and pay the $65 processing fee. If you cannot pay it, ask the clerk for the indigency form — the court has to waive it. Ask the clerk to stamp your copy.
  10. 10Sixty to ninety days later, run another CBI check. If the record still shows, call the clerk and ask about the order — JDF 615 is the order the judge signs. Tick the last box on your Filing Tracker only when a fresh check comes back clean.
